As we close the 3rd quarter or 2023, most would agree that the general state of society is decaying and is in need of a serious change. Central to this for our purpose, is, of course, the natural curiosity about the Global Settlements. As much as we would love to have unrestricted news on the matter, such a thing is just not possible. What you see released here, to greater or lesser degree, is as good as it can be. And it’s far more accurate and reliable than what is claimed elsewhere.

Case in point. Here is a brief comment and description of a backchannel communication between the key London GS trustee and an eager bureaucrat who felt entitled to demand a timetable on his terms:

China is not immune to the vagaries of world economics. They have a similar history of turmoil akin to that experienced by most other empires of the past. Today, however, the stakes are much higher and the penalties for failure are severe and swift. To maneuver such a hugely populated world from beneath a general collapse, while achieving and maintaining sensitive political consensus is going to take careful timing and skill. Such responsibilities are not placed in the hands of unproven, unaccomplished parvenus.

We can learn from this past example in China that great empires can falter if they do not act swiftly to events which require intelligent planning and execution. Take this as a reason that the present ongoing GS matters must be guided and implemented with great care, or we risk a collapse of unimaginable magnitude, in a world where thermonuclear thunderclaps may be the last sounds heard by man before our history disappears forever. – WHA

The Qing dynasty in China, despite its incredible socio-political success across two centuries, had collapsed to nothing by 1912. The reasons for the decline of the imperial system have long been debated, and a new study highlights three crucial factors that played a role – each of which are scarily familiar to us today.

Led by the Manchu people, the Great Qing took control of Beijing in 1644 and reached its greatest extent in terms of area by 1760. In 1820, the imperial dynasty had made China the world’s largest economy, but trouble lay ahead.

Here, researchers from Osaka University in Japan, Shanghai Normal University in China, the Evolution Institute and the University of Washington in the US, and the Complexity Science Hub Vienna in Austria, used structural-demographic theory (SDT) to chart the fall of the Qing dynasty.

The theory, which is based on mathematical models, splits societies into four sections: the state, the elites, the generation population, and an extra component that measures political instability. Each section influences the others in a dynamic way.

“We argue that the four-fold population explosion peaking in the 19th century, the growing competition for a stagnant number of elite positions, and increasing state fiscal stress combined to produce an increasingly disgruntled populace and elite, leading to significant internal rebellions,” write the researchers in their published paper.

Population growth led to overcrowding, poverty, and an overflow of qualified bureaucrats unable to rise up the ranks, the researchers say. The cost of keeping order, adding to burdens associated with depleting silver reserves and opium imports, exacerbated the problems even further.

It seems likely that the Qing rulers were fully aware of these problems – they just didn’t act smartly or quickly enough. A combination of internal uprisings and external geopolitical challengers ultimately sealed the fate of the dynasty.

“This clearly demonstrates that any economy must be vigilant as circumstances can change, and sometimes rather rapidly,” says Georg Orlandi, from Osaka University.

The team draws parallels between the conditions of the Qing dynasty’s fall and some of the issues and instabilities in today’s societies, including rising inequality and diminishing opportunities to progress – problems that governments would be wise to address.

That’s easier said than done though. These stresses often appear over the longer term, whereas governments are typically changing and evolving over the short term, and that means the fate of the Qing dynasty could well be repeated elsewhere.

“It’s crucial to comprehend the origins of such instabilities,” says Peter Turchin, from the Complexity Science Hub in Vienna, Austria. “Assuming it’s a thing of the past and can’t recur would be a mistake.”

“Such changes can indeed happen because the underlying mechanisms bear surprising similarities.”

The research has been published in PLOS ONE.

    The Biden administration seeks to use the judicial branch to gag President Trump from defending himself in public during the election from their criminal charges against him in the name of defending his right to an impartial jury in the District of Columbia. The irony of the statement expresses its absurdity well enough, especially in a district where courts selected juries in the middle of anti-defendant public hearings creating pervasive publicity attacking the defendant during jury selection did not even require a delay in the trial to assess juror impact.

    Gag orders are prior restraint on free speech, free press, and the right to petition the government. The First Amendment cannot condone gag orders. The Supreme Court recognizes as much, noting that even national security in a time of war cannot justify prior restraint. New York Times Co. v. United States, 403 U.S. 713, 714 (1971). The Supreme Court reiterated the rarity of permissive gag orders a half-decade later, demanding only the most extreme circumstances and the most limited of restraints. Nebraska Press Ass’n v. Stuart, 427 U.S. 539, 559 (1976).

    “Any system of prior restraints of expression comes to this Court bearing a heavy presumption against its constitutional validity.” Bantam Books, Inc. v. Sullivan, 372 U.S. 58 (1963). “The thread running through all these cases is that prior restraints on speech and publication are the most serious and the least tolerable infringement on First Amendment rights.” Nebraska Press Ass’n v. Stuart, 427 U.S. 539, 559 (1976). Justices Black and Douglas called such restraint “flagrant, indefensible, and continuing violation of the First Amendment.” New York Times Co. v. United States, 403 U.S. 713, 724 (1971). This is especially true of information embarrassing to the government: “It is common knowledge that the First Amendment was adopted against the widespread use of the common law of seditious libel to punish the dissemination of material that is embarrassing to the powers-that-be.” New York Times Co. v. United States, 403 U.S. 713, 724 (1971).

    The United States Supreme Court long ago recognized that any attempt to punish speech “outside the court room which comment upon a pending case” would “weigh heavily” toward unconstitutionality. Bridges v. State of Cal., 314 U.S. 252, 260 (1941). Only speech that presented a “clear and present danger” to the ability of the courts to function could even be considered for proscription or punishment. Bridges v. State of Cal., 314 U.S. 252, 262 (1941). Indeed: “what finally emerges from the clear and present danger cases is a working principle that the substantive evil must be extremely serious and the degree of imminence extremely high before utterances can be punished.” Bridges v. State of Cal., 314 U.S. 252, 263 (1941).

    Free speech must enjoy “the broadest scope” including “explicit language” as a “liberty-loving society” must allow. Bridges v. State of Cal., 314 U.S. 252, 263 (1941). The Supreme Court expressly rejected the idea that inherent court power permitted gag orders, noting the First Amendment was intended to prohibit precisely such misuse of judicial power. Bridges v. State of Cal., 314 U.S. 252, 264 (1941). As eloquently explained by the Supreme Court in Bridges: “The assumption that respect for the judiciary can be won by shielding judges from published criticism wrongly appraises the character of American public opinion. For it is a prized American privilege to speak one’s mind, although not always with perfect good taste, on all public institutions. And an enforced silence, however limited, solely in the name of preserving the dignity of the bench, would probably engender resentment, suspicion, and contempt much more than it would enhance respect.” Bridges v. State of Cal., 314 U.S. 252, 264 (1941).

    In Zauderer v. Office of Disciplinary Counsel, 471 U.S. 626 (1985), the U.S. Supreme Court again voiced its skepticism about efforts to regulate public speech merely because the speech is made by an attorney, noting the state has no general sufficient interest “substantial enough to justify the abridgment of their First Amendment rights” when it concerns “communications with the public” (Zauderer, supra, 471 U.S. at 647-648; see also: Standing Committee on Discipline of U.S. Dist. Court for Cent. Dist. Of California v. Yagman, 55 F.3d 1430, 1444 (9th Cir. 1995) [Where “the danger under this record to fair judicial administration has not the clearness and immediacy necessary to close the door of permissible public comment,” no sanction can issue (citing Pennekamp v. State of Florida, 328 U.S. 331 (1946)]; and see: In re Goode, 821 F.3d 553, 561 (5th Cir. 2016) [The Fifth Circuit recently striking down a court order sanctioning an attorney for speaking to the press during a jury trial because it failed to meet the Constitutional standard that any court action must only restrict attorney speech that is “sufficiently narrow to eliminate substantially only that speech having a meaningful likelihood of materially impairing the court’s ability to conduct a fair trial”, and even then the restriction must be “narrowly tailored to only prohibit such speech” and be the “least restrictive means of safeguarding against prejudice” given alternative remedies of venue and voir dire].)

    Indeed, court orders proscribing or punishing speech are “repugnant to the First Amendment to the Constitution.” Parker v. Columbia Broadcasting System, Inc., 320 F.2d 937 (2d Cir. 1963). Any proscription on speech must raise a “reasonable likelihood of prejudicial impact” on the functioning the judiciary itself. Connecticut Magazine v. Moraghan, 6767 F.Supp. 38, 43 (D. Conn. 1987). Free discussion, and court openness in high profile cases, make gag orders and closure orders alike Constitutionally dubious, while undermining, not aiding, public confidence in the judiciary. See State v. Kelly, 45 Conn.App. 142, 148 (Conn. App. 1997).

    Generally, a court’s in-courtroom power over speech or general power of lawyers does not allow restriction on speech to an ordinary citizen merely because they are a party to the case. See In re Sawyer, 360 U.S. 622 (1959). In one of the most famous quotes in this area of law, appellate courts, the Supreme Court, district courts, state courts, and scholars alike often repeat: litigants do not “surrender their First Amendment rights at the courthouse door.” In re Halkin, 598 F.2d 176, 185 (D.C. Cir. 1979). “A judicial order restraining speech casts the judge in a role comparable to that of a censor.” In re Halkin, 598 F.2d 176, 185 at n.17 (D.C. Cir. 1979). A citizen being a party to a case does not “make out of court remarks more censorable.” In re Sawyer, 360 U.S. 622, 636 (1959).

    In particular, fellow federal courts noted the rule limiting out-of-court discussion of a party or witness could not be constitutional unless the court found the specific statement posed a serious and imminent threat to the court’s ability to perform its task. Chi. Council of Lawyers v. Bauer, 522 F.2d 242 (7th Cir. 1975). For First, Fifth and Sixth Amendment reasons, speech-regulating rules “must be neither vague nor overbroad.” Chi. Council of Lawyers v. Bauer, 522 F.2d 242, 249 (7th Cir. 1975). Even statements that “impair the orderly and fair administration of justice in a pending case” cannot be restricted or sanctioned given the paramount interest of free speech. Chi. Council of Lawyers v. Bauer, 522 F.2d 242, 249 (7th Cir. 1975). Critically, the “serious and imminent” threat standard “must always be an element of any prohibition” on attorney speech. Chi. Council of Lawyers v. Bauer, 522 F.2d 242, 251 (7th Cir. 1975). Therefore, the Seventh Circuit struck down any rule that did not pose a serious and imminent threat of interference with the court’s ability to perform its tasks. Chi. Council of Lawyers v. Bauer, 522 F.2d 242 (7th Cir. 1975). No rule can restrict attorney speech unless the attorney’s conduct “poses either a clear and present danger or a serious and imminent threat” to the court’s ability to perform its task. In re Goode, 821 F.3d 554, 560 (5th Cir. 2016). This has been translated into a requirement that no rule can restrict lawyer speech unless the court finds that speech “has a meaningful likelihood of materially impairing the court’s ability to conduct a fair trial.” In re Goode, 821 F.3d 554, 561 (5th Cir. 2016).

    Following the Seventh Circuit, the Fifth Circuit reiterated that blanket prohibitions on categories of attorney speech cannot meet Constitutional muster unless “the particular statement posed a serious and imminent threat of interference with a fair trial.” In re Goode, 821 F.3d 554, 561 (5th Cir. 2016) (quoting Chi. Council of Lawyers v. Bauer, 522 F.2d 242, 251 (7th Cir. 1975). The Fifth Circuit noted the court must find the statement cannot be cured by “change of venue, jury sequestration, searching voir dire, and emphatic jury instructions” before it can impose limits on attorney speech about public matters. In re Goode, 821 F.3d 554, 561 (5th Cir. 2016). The Court struck down the district court’s sanction as imposing a rule in violation of the First Amendment. In re Goode, 821 F.3d 554, 561 (5th Cir. 2016).

    The Supreme Court also held in Craig v. Harney, 331 U.S. 367 (1947), that “the unequivocal command of the First Amendment serves a constant reminder that freedom of speech and of the press should not be impaired . . . unless there is no doubt that the utterances in question are a serious and imminent threat to the administration of justice.” “The vehemence of the language used is not alone the measure of the power to punish. The fires which it kindles must constitute an imminent, not merely a likely, threat to the administration of justice. The danger must not be remote or even probable; it must immediately imperil.” Id. at 367.
    In Sawyer, a disciplinary charge was made against an attorney who made publicly disparaging comments about the presiding judge during the trial. The attorney questioned the judge’s impartiality and judicial integrity. On appeal to the U.S. Supreme Court, the Court held that an attorney can question judicial integrity, the law at issue, law enforcement agencies, the government and prosecution “even to suggest wrongdoing on their part.” See: In re: Sawyer, 360 U.S. 622, 631 (1959).

    Criminal cases are no exception. Nebraska Press Ass’n v. Stuart, 427 U.S. 539, 559 (1976); Gentile v. State Bar of Nevada, 501 U.S. 1030 (1991). In Stuart, a trial court issued a gag order for an upcoming criminal case. The gag order concerned a high-profile murder trial and limited itself to the publication of potentially inadmissible information incriminatory of the accused, including confessions. The right to an unbiased jury did not justify broad prior restraint of First Amendment freedoms. Instead, “the protection against prior restraint should have particular force as applied to reporting of criminal proceedings.” Nebraska Press Ass’n v. Stuart, 427 U.S. 539, 559 (1976). The court invalidated the gag order on First Amendment grounds in unanimity.

    The Stuart standard established required every other alternative be sought to protect an impartial jury rather than prior restraint on speech. This included: changing venue or the jury pool; postponement of the trial; probing voir dire; instructions to the jury; and the like. Of note, if the information simply reflects admissible evidence, then the jurors pre-trial access to its much less prejudicial. The primary concern is inadmissible information accessed by the jury in a way that cannot be cured by judicial instruction or juror selection. Gag orders rarely can be narrowly tailored means to such ends.

    The issue next arose for the Court in Gentile. Gentile v. State Bar of Nevada, 501 U.S. 1030 (1991). There, the case concerned post-speech punishment of a lawyer’s statements for a criminally charged defendant. The court noted prior restraint required a higher standard than post-speech punishment of a lawyer. For prior restraint, there must be “clear and present danger” of “actual prejudice” or “imminent threat” to justify any restraint, and even then the restraint must be narrowly tailored to remediate that danger only. Gentile v. State Bar of Nevada, 501 U.S. 1030 (1991).

    The Gentile court found no court can punish the speech of a lawyer unless the lawyer’s conduct causes a “substantial likelihood of material prejudice” to the judicial proceedings. (Gentile, supra, 501 U.S. at 1039) “Material prejudice” in this context, means conduct “likely to influence a trial’s outcome” in an impermissible manner. (Id., at 1031-1032) This requires “releasing information of grave prejudice on the eve of jury selection”, or analogous conduct. (Id., at 1036) Indeed, “the phrase ‘substantial likelihood of material prejudice’ might punish only speech that creates a danger of imminent and substantial harm.” (Ibid.) Even under the lesser “substantial likelihood of material prejudice” standard, a lawyer could not be prohibited or punished for making speech about a pending criminal case that concerned potentially inadmissible and prejudicial information months before trial given alternative remedies and inadequate threat to impartial justice. The court noted the right of a defendant and counsel “to demonstrate in the court of public opinion that the client does not deserve to be tried.” Gentile v. State Bar of Nevada, 501 U.S. 1030, 1032 (1991).

    Finally, as eloquently summarized by the Court in Gentile regarding out-of-court statements by effective counsel: “To the extent the press and public rely upon attorneys for information because attorneys are well-informed, this may prove the value to the public of speech by members of the bar. If the dangers of their speech arise from its persuasiveness, from their ability to explain judicial proceedings, or from the likelihood their speech will be believed, these are not the sort of dangers that can validate restrictions. The First Amendment does not permit suppression of speech because its power to command assent.” (Gentile, supra, 501 U.S. at 1056-1057)

    The courtroom is a protected space; the court of public opinion isn’t.

      I did a few of these in my early career in insurance, including one Mercedes that fell off of the lift and crushed a dog. The owner didn’t care about the dog because he was a few days from surrendering it to his ex wife as part of a divorce, but the car damage almost drove him to drink. Fires from welding mufflers near leaky gas tanks were always fun. Oil changes that forgot to add the new oil were always a hoot. “I saw the red warning light and heard a horrible screeching, so I decided to drive back to the shop but the engine stopped before I got there.” 🙄

      2. I got my oil changed, drove across town, and my car caught on fire under the hood. I had just stopped at a coin shop, got out and looked under the hood after seeing smoke, and went in to see if they had a fire extinguisher. Luckily they did and put the fire out. The mechanic did not screw the oil cap on and it blew off and caused oil to come out. Called car lot and they came and took car back and took care of it and checked car out. Scary.

        1. Yep! The newer cars have installed baffles on the oil fill ports so that if the cap comes off or is left off, the oil will not spurt out over a hot engine.

          When retrieving my car from service, I always do an inspection under the hood. You would be amazed how many times they leave things undone. Loose caps, uncovered battery terminals, prop rods dislodged. etc.

    1. San Diego, despite all the personal and professional heartache that happened there, was truly a beautiful place and my home for many years. The weather was every bit as good as advertised. The people were both nice and true and a stark contrast to Los Angeles fakery. It got me back into bodybuilding, though that round was more for health than vanity. Post-divorce I moved down to Pacific Beach less than 5 minutes from ritzy LaJolla. The night life was active and fun across 15-20 miles of beach front.

      My Wednesdays took me to a sushi restaurant where afternoons of saki blended with multi-hour discussions of the latest developments in physics and science with a constantly changing mix of scientists anchored/chaired by my friend MOHPHD. Along with many visiting folks of note, was Dr. Kari Mullis of Nobel and PCR fame, who was a truly delightful mind.

      This crazy illegals situation just breaks my heart, not only here for NYC, and San Diego, but also for Lampedusa.

        The QQQ is an exchange traded fund (ETF) that features shares in the NASDAQ 100. This last transaction involved buying an option on that exchange to sell/short 100 shares of the QQQ at a certain price by a certain date. This is known as a PUT option. The option itself is a contract, not the shares. These are regularly bought and sold on the options market.

        I would suggest you simply search for how options work on Youtube or any such site that you can find that gives you an overview of how they work. They are available through most US brokerages, and also are available to many non-US persons who have accounts registered to trade any US securities.

        Check the securities laws in your country for details on accessing the US options market.

        We will be bringing on other classes of such trades in the near future. At present, my office is undergoing a revamping and upgrading of hardware so it will be a while before we expand in that sense. But, it will happen!
